Please read these Terms & Conditions (“Terms”) carefully before using www.bmsl.com.bd (the “Site”), operated by Barakah Marine Service Ltd. (“BMSL,” “we,” “us,” or “our”). By accessing or using the Site, submitting an application, or making an inquiry, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Our Services

BMSL is a marine manpower supply and crew manning agency based in Bangladesh. We connect qualified seafarers (officers and ratings) with ship owners, ship management companies, and crewing agencies. Use of this Site to register as a seafarer or to submit a crewing requirement does not, by itself, create a contract of employment, manning agreement, or guarantee of placement. Any actual engagement, employment, or manning arrangement is subject to separate agreement between the relevant parties.

2. Eligibility and Accuracy of Information

By submitting a Crew Registration, Document Upload, or any other form on this Site, you confirm that:

  • You meet the applicable age, certification, and legal requirements to work as a seafarer, or you are an authorized representative of the company submitting an inquiry
  • All information and documents you provide are true, current, and accurate
  • You have the right to submit any documents you upload, and they are genuine and unaltered

Submitting false, misleading, or fraudulent information or documents may result in your application being rejected and, where applicable, reported to relevant authorities.

3. No Guarantee of Placement or Recruitment Outcome

Registering with BMSL does not guarantee that you will be offered a position, interviewed, or shortlisted. Similarly, submitting a crewing requirement does not guarantee that BMSL will be able to fulfil it within any particular timeframe or at all. All placements are subject to the specific requirements of ship owners and ship management companies, candidate suitability, documentation verification, and medical fitness, among other factors.

4. Document Submission

You are responsible for the accuracy, legibility, and validity of any documents you upload (including your passport, CDC, STCW certificates, medical certificate, seaman’s book, and other supporting certificates). We accept PDF, JPG, and PNG files up to the size limit displayed on the relevant form. We reserve the right to request original or additional documentation before finalizing any placement.

5. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms
  • Submit false information, impersonate another person, or misrepresent. your affiliation with any company
  • Attempt to gain unauthorized access to any part of the Site, its underlying systems, or other users’ information
  • Upload any file containing viruses, malware, or other harmful code
  • Use automated means (bots, scrapers) to access or extract content from the Site without our prior written consent

We reserve the right to remove any submission and refuse service to anyone who violates these Terms.

6. Intellectual Property

All content on this Site — including text, graphics, logos, and images (excluding user-submitted documents and third-party images credited to their respective owners) — is the property of BMSL or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our prior written permission.

7. Third-Party Links and Services

This Site may contain links to third-party websites or services (including WhatsApp and Google Maps) that are not owned or controlled by BMSL. We are not responsible for the content, privacy practices, or terms of any third-party site or service.

8. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available” without warranties of any kind, whether express or implied. While we strive to keep information on the Site accurate and up to date (including vacancy listings), we do not warrant that the Site will be error-free, uninterrupted, or that vacancy or company information is complete or current at all times.

9. Limitation of Liability

To the fullest extent permitted by applicable law, BMSL shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site, your application, or any recruitment outcome (or lack thereof), including but not limited to loss of income, opportunity, or data.

10. Indemnification

You agree to indemnify and hold harmless BMSL, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your breach of these Terms, your misuse of the Site, or the information/documents you submit.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the People’s Republic of Bangladesh, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.

12. Changes to These Terms

We may revise these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
